TICKETEK REWARDS TERMS OF USE

The Ticketek Rewards program, located at www.ticketekrewards.com.au (the “Site”), is operated by Ticketek Insights Pty Ltd owned by Ticketek Pty Ltd (ABN 92 010 129 110) ("TICKETEK").

Your access to the Site is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained in this document and elsewhere on the Site (known collectively as "Terms of Use"). Your use of, and/or access to, the Site constitutes your agreement to the Terms of Use. Ticketek Rewards reserves the right to amend the Terms of Use at any time. Since you are bound by the Terms of Use, you should periodically refer to them on the Site.

As a member (“Member”) of the Ticketek Rewards program, you will receive offers to purchase products and services (“Special Offers”) and invitations to participate in focus groups, telephone interviews and online surveys ("Research Offers") from Ticketek Rewards on behalf of third party organisations (“Clients”). In return for your acceptance of these offers, you will receive “Ticketek Dollars” which can be redeemed for purchases of tickets through Ticketek.

1. ACKNOWLEDGMENTS

You acknowledge that as a Member of Ticketek Rewards:

You must be 18 years of age or older

You are an Australian permanent resident.

You agree to receive Special Offers and Research Offers, acknowledging that you can "opt-out" of receiving these offers at any time.

You understand and accept that you will not disclose any information to any other party regarding the contents of market research surveys in which you participate. All information you view in surveys is strictly confidential.

You have no objection with Ticketek Rewards using the information you provide during registration to determine if your profile matches the requirements of our Clients.

You understand that Ticketek Rewards does not send Research Offers of its own unless clearly notified on the invitation that the survey is from Ticketek Rewards.

You understand that Ticketek Rewards has no control over the content or subject matter of offers or the results or invitations to view the results that these offers generate.

You understand that if an offer asks for personal information about you and you choose to supply it to the third party, Ticketek Rewards has no control over the third party's use of that personal information.

You understand that you will be awarded Ticketek Dollars for each completed Special Offer or Research Offer according to the terms and conditions of each offer.

You understand that unless otherwise stated, all Ticketek Rewards offers are by invitation only and individuals may participate only once in each Ticketek Rewards offer to which they are invited.

You understand that unless otherwise stated, participants who do not receive invitations directly from Ticketek Rewards or from a company contracted by Ticketek Rewards or its Clients are not eligible for Ticketek Rewards. Individuals who attempt to participate in Research Offers or Special Offers multiple times are not eligible for Ticketek Rewards.

You understand that unless otherwise noted, only one person per household may participate in each Ticketek Rewards offer.

You understand and accept that Ticketek Rewards may track your use of the Site and may freely use and disclose any information and materials received from you or collected through your use of the Ticketek Rewards Site for any lawful reason or purpose, in accordance with the guidelines set forth in its Privacy Policy.

2. MODIFICATION TO SERVICES PROVIDED

The Member acknowledges and agrees that Ticketek Rewards may, with or without notice, modify, delete, or amend the Services and/or Site provided hereunder. Ticketek Rewards will notify the Member of any modification, deletion or amendment on the Site by email or otherwise. If the Member does not accept the modification, deletion or amendment, the Member must terminate the Member's registration at that time. Any and all use of the Site or the Services by the Member after the notice is posted shall be deemed to be acceptance of the modification, deletion or amendment (as well as all other terms and conditions) to the Services, Site or Terms of Use.

3. REGISTRATION

The Member shall provide current, complete, and accurate information in the registration section of the Site. The Member shall further update and keep such information accurate over time. The Member must be 18 years of age or older to participate in the Ticketek Rewards program. The Member is solely responsible for maintaining the confidentiality of the Member’s account information. The Member shall immediately notify Ticketek Rewards of any unauthorised account activity, or any unauthorised use or any other breach of security known to the Member.

4. TERMS AND CONDITIONS FOR PAYMENT OF SPECIAL OFFERS

Members shall receive two forms of Special Offers, with each invitation clearly indicating the form applicable to the invitation. Each of these forms of Special Offers is defined below with the minimum terms and conditions required for payment of Ticketek Dollars:

“Pay Per View” Offers – where payment of Ticketek Dollars is tied to the viewing of marketing material accessible through a link in the invitation for that Offer. Members will receive payment of Ticketek Dollars for Pay Per View Offers if the Member satisfies all of the following:

The Member is invited to participate in the Special Offer by way of an email invitation

The Member views the Special Offer by clicking on the link provided in the invitation prior to the close date for that offer. The close date will be specified in the invitation for the Special Offer.

In all circumstances, Ticketek Rewards reserves the right to refuse payment of Ticketek Dollars to a Member for a Pay Per View Offer if the Member does not click on the link to view the marketing material provided in the invitation.

Pay Per Purchase” – where payment of Ticketek Dollars is tied to the purchase of the product or service which is promoted in the Special Offer. Members will receive payment of Ticketek Dollars for Pay Per Purchase Offers if the Member satisfies all of the following:

The Member is invited to participate in the Special Offer by way of an email invitation

The Member purchases the product or service offered by the Client of Ticketek Rewards prior to the close date for that offer. The close date will be specified in the invitation for the Special Offer.

Rewards reserves the right to offer a Member a reduced Reward for a Pay Per Purchase Special Offer in circumstances where a Member accepts a Special Offer to purchase but is declined by the Client making the offer

5. TERMS AND CONDITIONS FOR PAYMENT OF RESEARCH OFFERS

Ticketek Dollars will be paid to a Member for a Research Offer if the Member satisfies all of the following criteria:

The Member is invited to participate in the Research Offer by way of an email invitation

The Member completes all responses to the Research Offer accurately and honestly

The Member is not disqualified from the Research Offer by virtue of the responses provided.

The Member responds to the offer prior to the close date for that offer. The close date will be specified in the invitation for each Research Offer.

The Member responds prior to the quota for number of respondents being reached for that Research Offer

Ticketek Rewards reserves the right to offer a Member a reduced fee in circumstances where a Member:

Completes a Research Offer prior to the close date for an offer, and prior to a the quota of responses being reached, but where the Member’s responses disqualify the Member from inclusion in the Research Offer

Completes a survey prior to the close date for the offer, but after the quota of responses established for the Research Offer has been reached

In all circumstances, Ticketek Dollars reserves the right to refuse payment of Ticketek Dollars to a Member if:

The Research Offer is submitted partially completed, or the Member does not respond to the Invitation

If the Research Offer has been completed inaccurately or dishonestly

6. PAYMENTS TO PERSONAL ACCOUNTS

Ticketek Dollars will be payable for Research Offers upon completion of the entire marketing research study, survey, focus group or telephone interview for which the invitation was made. With Special Offers, Ticketek dollars will become payable upon either agreeing to view the details of the offer, or upon purchase of the product or service offered.

Ticketek Rewards will not be responsible if the Member deletes or changes their email address before they have been credited for their participation in a particular offer. Ticketek Dollars will be deposited in a Member’s personal account web page with the amounts displayed. The Member will only receive a gift certificate after the Member has accumulated $25 Ticketek Dollars. Gift certificates are only available for the following amounts; $25, $30, $40, $50, $60, $70, $80, $90 and $100.

7. INACTIVE PERSONAL ACCOUNTS

Ticketek Rewards shall have the right to close a personal account if the Ticketek Rewards account is inactive for a period of 12 months. The Member shall not be compensated for funds lost in an account that is closed due to inactivity.

8. ACCURATE AND TRUTHFUL INFORMATION

The Member shall provide accurate and truthful registration information. Only the Member shall provide survey information when completing a Research Offer through the Members account. The Member warrants that the opinions and statements given in a survey response represent the Members true opinion or view. Furthermore, Ticketek Rewards shall have the right to analyse the Members survey responses for accuracy and truthfulness. If Ticketek Rewards has reason to believe that the Member is not providing accurate and truthful registration or survey information, or if the Member is allowing someone other than the Member to contribute to survey responses, Ticketek Rewards shall have the right to terminate the Members account and the Member shall not be compensated for any funds in the Members account.

9. ABUSE & DISPUTES.

The following actions are considered abuse and cause for immediate termination from Ticketek Rewards. When terminated, the Member’s Ticketek Rewards account will be closed and the Member shall forfeit all Ticketek Dollars in the Members account at the time of termination.

Registering with Ticketek Rewards by giving us false or misleading information

Changing your profile and giving false or misleading information

Creating multiple Ticketek Rewards accounts

Taking the same survey more than once

Taking a survey, not qualifying, then taking the same survey again with knowledge of how to get through the qualifying process

Telling another member how to get through the survey qualifying process

Intentionally giving faulty responses on a survey

Completing a survey so quickly that you would not have been physically able to read the questions

Posting details of offers from Ticketek Rewards and clients links to surveys anywhere on the Internet

If we request as specific the Member profile in our email invite and you do not fit that profile, but attempt to take the survey anyway

Registering or changing user profile with usernames or email addresses that Ticketek Rewards deems indecent

Unable to answer profile verification questions

If you want to dispute your termination, you will be required to give us your drivers licence and full name and postal address, so we can verify your registration information with State records. Disputes are for Australian permanent residents only. After we have run a check on your profile, if we should decide to re-open your account we will re-open your account and deliver you an email statement as to why your account was closed. If your records do not match, your account will remain closed and no further action will be taken. If you are from outside the Australian, we will not be able to process your dispute and there will be no recourse, your account will remain closed.

10. PRIVACY.

11. NO SPAMMING OR JUNK MAIL.

From time to time, Ticketek Rewards may solicit feedback on services provided by the site. The Member warrants that the Member use of the Site or membership of the Ticketek Rewards program will not violate any spamming, junk mail or other related laws or regulations prohibiting or discouraging unsolicited mail. If you have breached the Terms of Use, Ticketek Rewards will report such conduct to the appropriate authorities and turn over any and all information, including personally identifying information, to appropriate persons or entities.

12. PROPRIETARY RIGHTS.

Ticketek Rewards owns the content, including the graphics, names, text, software, music, videos, sound, pictures, compilations, survey templates, surveys, survey responses, survey results, related survey data, focus group process, focus group responses, focus group results, telephone interview process, telephone interview responses, telephone interview results, page layout, design, processes, procedures, magnetic translation, digital conversion or other material contained on the Site and used for the Ticketek Rewards program. All content is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. No one may copy, reproduce, distribute in any way, or decompile, reverse engineer or disassemble the content. Modification or use of the content in any other way is a violation of copyright and other proprietary laws. No one may copy, reproduce, transmit, post, distribute or create derivative works from this Site without prior express authorization.

13. ADVERTISERS AND LINKS.

Ticketek Rewards may provide advertising space and/or links and pointers to Internet sites maintained by third parties. Ticketek Rewards has not reviewed all of the third party sites nor reviewed any products or services they may provide. Ticketek Rewards is not responsible for nor does it endorse the contents or any products or services of such third parties or their sites. Ticketek Rewards does not control in any respect any information, products or services offered or suggested by third parties on the Site. Ticketek Rewards does not endorse or otherwise warrant or guarantee the products or services that are either advertised on the Site or connected by link.

14. INDEMNIFICATION.

The Member agrees to defend, indemnify and hold harmless Ticketek Pty Ltd, Ticketek Rewards, its parent entities, subsidiaries, affiliates, officers, and employees, for any and all claims and demands, including attorney's fees, due to or arising from the Members use of the Service and any other conduct related in any way to the Service or the Site, including but not limited to breaching any warranty or provision contained in these Terms of Use.

15. TERMINATION.

In addition to termination as a result of the Members Abuse, these Terms of Use may be terminated by either party hereto at any time. Ticketek Rewards shall not be liable to the Member or any third party in any manner for termination of the Service. In the event the Member should become dissatisfied with the Terms of Use or any modifications thereof, or with the Service or the Site, the Member’s only recourse is to discontinue use of the Service and terminate registration. Upon termination, the Member’s right to use the Service and the Site cease immediately and the Member will not be compensated for any funds in the Member’s account.

16. JURISDICTION.

The Terms of Use and the relationship between the Member and Ticketek Rewards shall be treated as if entered into and executed in Australia and shall be governed and construed in accordance with the laws of Australia, without regard to conflict of law principles. The Member agrees to submit to personal and exclusive jurisdiction and venue of the courts in Australia. Ticketek Rewards makes no representation that the materials and content on the Site or relating to the Services are appropriate or available for use in other locations, and accessing them from territories where their contents are illegal is strictly forbidden. Those who access the Services or the Site from other locations do so on their own initiative and at their own risk and are responsible for compliance with local laws. Any claim or demand under the Terms of Use must be made within one year of the occurrence.

17. GENERAL PROVISIONS.

In any dispute arising from the relationship between the Member and Ticketek Rewards or the Terms of Use, the prevailing party shall be entitled to reasonable attorney's fees and costs. The failure by Ticketek Rewards to enforce any right or provision under the Terms of Use shall not constitute a waiver of that provision or any other provision of the Terms of Use. If any provision of the Terms of Use shall be determined to be invalid or unenforceable by a court of competent jurisdiction, the other provisions of the Terms of Use shall remain in full force and effect.

18. LOG FILES.

Ticketek Rewards may use IP addresses, cookies, browser type, referring urls, operating system, and date/time stamp to analyse trends, administer the site, track the Members activity, and gather broad demographic information for aggregate use in optimising the performance of our site and our services or determine abuse.

19. NATURE OF AGREEMENT.

Ticketek Rewards may use IP addresses, The Member agrees that the registration procedure and subsequent activation of the "I AGREE" button constitute agreement to the Terms of Use. Further, the Terms of Use is the entire and only agreement between the parties and supersedes any prior or other understandings, representations or warranties. The Member agrees that each use of the Services and the Site reaffirms the Member’s acknowledgment and agreement to the Terms of Use.
